These Terms & Conditions ("Terms") govern the provision of courier, same-day delivery, last-mile logistics, mobile notary, port services, airplane-on-ground (AOG) recovery, document handling, and related transportation services ("Services") offered by HCBS Logistics ("we," "us," "our," or "Company"), a Florida-based courier business operating primarily in South Florida. By requesting, booking, or using our Services, or accessing https://www.hcbslogistics.com (the "Site"), you ("Customer," "you," or "your") agree to be bound by these Terms.

1. Acceptance of Terms
Your use of our Services constitutes acceptance of these Terms, our Privacy Policy, and any applicable quotes or booking confirmations. We may update these Terms at any time; continued use after changes constitutes acceptance.

2. Services Provided
We provide non-exclusive, on-demand courier and logistics services, including but not limited to:

Time-sensitive deliveries (local/over-the-road)

Medical/pharmaceutical specimen transport

Port-to-door/door-to-port and airport/port transfers
-
AOG cargo recovery
-
One-way and two-way document courier with mobile notary

Last-mile non-medical shipments
Services are performed as an independent contractor. We select routes, carriers, and methods at our discretion unless specified in writing.

3. Customer Responsibilities
You warrant that:

All information provided (addresses, package descriptions, contents, value) is accurate and complete.

Shipments comply with all laws, do not contain prohibited items (e.g., hazardous materials without declaration, illegal goods).

You have authority to tender the shipment and any required consents (e.g., for medical/notary items).

Packages are properly packaged, labeled, and prepared for transport.
You agree to indemnify us against claims arising from inaccurate information, prohibited contents, or your breach of these warranties.

4. Prohibited Items & Restrictions
We do not accept: hazardous materials (unless properly declared and compliant), perishables without cold-chain request, valuables over declared limits, live animals, firearms/ammunition, or illegal substances. We reserve the right to refuse, inspect, or reject any shipment.

5. Charges, Payment & Billing

Rates are quoted based on provided details and subject to change if actual shipment differs.

Payment is due at booking or upon delivery (cash, card, invoice for approved accounts).

Additional fees apply for waits, redeliveries, fuel surcharges, or special handling.

Late payments incur interest at 1.5% per month. We may suspend services for non-payment.
6. Delivery & Performance
We aim for on-time delivery per your requested schedule but do not guarantee exact times unless expressly agreed in writing. Delays due to traffic, weather, customs, address issues, or force majeure are not our liability. We provide tracking where available.
7. Liability & Limitations

Our liability for loss, damage, or delay is limited to the lesser of: actual value (with proof), declared value (up to $100 default unless higher declared and fee paid), or $0.50 per pound.

We are not liable for consequential, indirect, special, or punitive damages (e.g., lost profits, business interruption).

No liability for inherent vice, improper packaging, or acts of God.

Claims must be filed in writing within 15 days of delivery (or expected delivery for non-delivery), with supporting documentation. Late claims are waived.
8. Insurance
We do not automatically insure shipments. Optional declared value coverage may be available for an additional fee. You are responsible for insuring high-value items.

9. Notary Services
Mobile notary acts comply with Florida law. We maintain notary journals as required. You warrant documents are lawful and you have authority for notarization. We are not liable for document content or legal validity.

10. Force Majeure
We are not liable for delays or failures due to events beyond our control (e.g., weather, strikes, pandemics, government actions).

11. Indemnification
You agree to indemnify, defend, and hold us harmless from claims, losses, or damages arising from your breach of these Terms, shipment contents, or your negligence.

12. Governing Law & Dispute Resolution
These Terms are governed by Florida law. Any disputes shall be resolved exclusively in Broward County, Florida courts. You waive jury trial rights where applicable.

13. Termination & Suspension
We may suspend or terminate services for non-payment, prohibited shipments, or breach of Terms.

14. Entire Agreement
These Terms, any quote/confirmation, and our Privacy Policy constitute the full agreement. No oral modifications.
